By downloading, installing, or using the Sunote mobile app ("App"), you agree to these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms form a binding agreement between Ufuk Özen ("we," "us," "our," or "developer") and you ("user" or "you").
For apps downloaded through the App Store, Apple's Standard End User License Agreement may also apply. These Terms govern the Sunote service and are not intended to replace Apple's Standard EULA unless a separate custom EULA is presented through App Store Connect.
Sunote is an AI-powered note-taking app. It offers voice notes with Apple's native Speech framework, AI summaries, action items, quizzes, flashcards, mind maps, web notes, visual notes, AI chat, Apple Watch capture, and subscription-based premium features. Sunote is local-first: it does not provide CloudKit, iCloud, or other Sunote-managed cross-device note synchronization, cloud backup, or recovery. The production AI chain is Sunote Cloudflare Worker → OpenRouter → Google Gemini 2.5 Flash Lite. The App does not send raw audio files to OpenRouter or Google Gemini for AI note summarization. Sunote cannot create new notes from YouTube URLs and does not retrieve YouTube transcripts. Existing locally stored legacy YouTube notes may remain readable and may display the original video through an embedded player for data compatibility.
Sunote does not use a traditional account system with a username, email address, password, or profile. Access and service operation use Apple's App Attest, a client instance identifier, StoreKit 2 App Account Token, subscription transaction evidence, and related pseudonymous technical records. We do not provide CloudKit, iCloud, or other Sunote-managed cross-device sync for your note library; notes, recordings, photos, transcripts, and AI outputs are stored locally on the device by default. Deleting the App, losing or resetting the device, clearing local App data, or local storage corruption may make local content unavailable. Apple controls iCloud device backup and restore behavior, and Sunote does not guarantee recovery of locally unavailable data.
You may try Sunote with 1 (one) free note. This free allowance is available only once per app/device context and includes AI features such as summary, quiz, flashcards, and mind map generation.
A premium subscription provides Pro note creation, Pro access to AI features, Apple Watch support, and an ad-free experience, subject to fair use, abuse prevention, security, technical capacity, and third-party API quota/performance limits.

Before purchase, the in-app paywall shows the subscription name, duration, current localized App Store price, renewal price, any trial period and post-trial charge, auto-renewal notice, restore-purchase path, subscription management/cancellation path, and links to the Privacy Policy and Terms.
Subscriptions renew automatically unless canceled. Payment is charged to the payment method associated with your Apple ID at purchase confirmation and on renewal. A subscription may renew if it is not canceled at least 24 hours before the current period ends. Existing subscribers can restore purchases in the App and manage subscriptions through iOS subscription settings.
You can cancel at any time in iOS Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period, and you can continue using premium features until that period ends.
All payments are processed by the Apple App Store. Refund requests are handled under Apple's refund process and applicable consumer rights. To request a refund, visit reportaproblem.apple.com. Sunote does not directly issue App Store refunds.
Allowed Create and edit your own notes, use AI features for personal note-taking, study, and productivity, export notes in Markdown format, and use web note features for lawful personal note-taking where permitted.
Prohibited Unlawful use, copyright infringement, AI abuse, spam or harmful content generation, rate-limit bypass attempts, App Attest or subscription validation bypass, security circumvention, hate or harassment content, and scraping private IP addresses, internal networks, or restricted systems.
Before remote AI features are used, Sunote explains that feature-specific content may be sent to the Sunote Cloudflare Worker, OpenRouter, and Google Gemini 2.5 Flash Lite, and asks for your explicit permission. Onboarding does not grant AI processing permission. You are responsible for reviewing AI-generated content. AI may be inaccurate or misleading, is not professional advice, and should not be relied on for medical, legal, financial, or other critical decisions.
You are responsible for obtaining any consent or other permission required to record, transcribe, upload, or otherwise process another person's voice or personal information. You must use the App in compliance with recording, privacy, copyright, and data-protection laws that apply to you. This does not make you responsible for matters that cannot lawfully be assigned to you or limit any rights that cannot be waived.
Sunote, including its code, design, logo, and original app content, is the intellectual property of Ufuk Özen. Your notes and content belong to you. If you grant permission for a remote AI feature, you allow the feature-specific content needed for that feature to be transmitted temporarily to the Sunote Cloudflare Worker, OpenRouter, and Google Gemini 2.5 Flash Lite. Sunote does not claim ownership of your user content, sell it, or use it for unrelated purposes.

AI-generated outputs may be based on your note content, may not be unique, and may be similar to outputs generated for others. You are responsible for ensuring that your inputs and outputs do not infringe third-party rights.

We are not responsible for the availability, performance, content, or policies of third-party services. You may use web note features only for lawful, personal note-taking where the relevant content provider permits that use.
The App is provided "as is" and "as available". We do not guarantee uninterrupted or error-free service. AI services may be temporarily unavailable because of third-party API status, rate limits, outages, or policy restrictions. We may modify, suspend, or discontinue the service or any feature at any time, subject to applicable law.
To the maximum extent permitted by applicable law, Sunote is not liable for damages arising from inaccurate or misleading AI-generated content, the inability to recover local content where Sunote has not provided cloud backup or recovery, loss caused solely by the user's failure to keep a copy of local content or by events outside Sunote's reasonable control, third-party service outages or errors, or indirect, incidental, special, consequential, or similar damages. Our total liability will not exceed the subscription fees you paid for Sunote in the last 12 months. These limits do not exclude or limit liability, rights, or remedies that cannot lawfully be excluded or limited, including mandatory consumer and data-protection rights, or liability arising from intentional misconduct, gross negligence, or unlawful processing where applicable law does not permit that limitation.
You agree to indemnify and hold us harmless from third-party claims, damages, expenses, and reasonable legal fees to the extent they arise from your unlawful use of Sunote, your recording or processing of another person's content without required permission, or your violation of these Terms. This applies only to the extent permitted by applicable law and does not cover claims caused by our own unlawful conduct or non-waivable responsibilities.
You may stop using Sunote at any time by deleting the App and may cancel your subscription through iOS Settings. Deleting the App or local App data may make locally stored notes, recordings, photos, transcripts, and AI outputs unavailable; Sunote does not guarantee their recovery. We may suspend or terminate access if we detect a violation of these Terms, abuse, unlawful activity, attempts to bypass rate limits, payment fraud, or subscription abuse.
Sunote is provided without express or implied warranties, to the maximum extent permitted by law. We do not warrant that the App will be fit for a particular purpose, that AI outputs will be accurate or complete, that the App will operate without interruption or error, or that third-party integrations will remain continuously available.
These Terms are governed by the laws of the Republic of Turkiye, without prejudice to mandatory consumer protection rules that may apply where you live. Courts and enforcement offices of the Republic of Turkiye may have jurisdiction, subject to mandatory consumer rights.
You are responsible for using the App in compliance with data protection, consumer, AI, content, telecommunications, registration, and licensing rules that apply where you are located. If additional registration, licensing, local hosting, or approval is required to provide the App in a country or region and those requirements are not satisfied, Sunote may restrict access there. Some features may also be unavailable where prohibited or restricted by local law or provider policy.
We aim to resolve disputes amicably first. For any dispute or concern, contact info@ufukozen.com. Your consumer rights are preserved, and you may contact local consumer protection authorities where applicable.
We may update these Terms from time to time. Material changes will be announced at least 14 days in advance through an in-app notice where appropriate. Subscription price changes are handled according to Apple policies. Continuing to use the App after changes take effect means you accept the updated Terms.
Sunote is distributed through the Apple App Store. These Terms are between you and the developer, not Apple. You receive a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
The developer is responsible for maintenance and support as required by applicable law; Apple has no obligation to provide maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price if applicable. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
The developer, not Apple, is responsible for addressing product liability, regulatory compliance, consumer protection, privacy, intellectual property, or similar claims related to the App. By using the App, you represent that you are not located in a U.S.-embargoed country or listed on any U.S. Government prohibited or restricted party list. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific terms against you.
